Terms Of Use

This policy represents the Adishost.com Terms of Service ("TOS") in its entirety and supersedes any other written or oral policy. This policy defines the terms of service all Adishost.com customers agree to when they use any of the Adishost.com web site hosting services.

AGREEMENT

In this Agreement ("Agreement") "you" and "your" refer to each customer, "we", us" and "our" or "Adishost" refer to Adishost.com and "Services" refers to the domain name registration, Web Hosting provided by us as offered through adishost.com, This Agreement explains our obligations to you, and explains your obligations to us for various Services or dedicated servers.

Account Setup

Adishost is a pre-paid provider. Once your yearly payment has been received & cleared, your account will be setup. The registered owner of an account is responsible for the actions of all parties using that account.

General Provisions

In consideration for GreenGeeks maintaining one or more accounts (each "Account"), you, as the GreenGeeks customer, agree to the following terms of service.

Publisher and author of web site

Adishost is not the publisher of any site that you host or create. As the publisher or author, it is your responsibility to ensure your web site(s) do not breach our terms and conditions. Adishost is not a web site publisher and is not resposible for or endorse the content hosted by or activities performed by you whilst using our services. From time to time, a client that experiences difficulties in publishing their web site or troubleshooting technical problems may request we publish their web site or modify their web site on their behalf. Adishost is this instance does not become the web site publisher and/or author and is making these changes by instruction of the Primary Account holder.

Client Content

Client agrees that web pages and files uploaded to servers will not violate any state, national or foreign laws or regulations; infringe on any intellectual property rights of Adishost or any third party; be defamatory, slanderous or trade libellous; be threatening or harassing; be discriminatory based on gender, race, age; promote hate; or contain viruses or other computer programming defects which result in damage to Adishost or any third party. Customers may not run IRC, bots or clients. Clients may not use Adishost servers for file storage unrelated to the client's web site, storage Space is for active web site file pages only. Adishosts' shared hosting account holders may not act as a reseller, which means that clients may not host any web sites in their addon domains that are not domains owned by the client on record at Adishost. You will need to opt-in for our reseller hosting service. Unacceptable uses alsoinclude: Bulk unsolicited emailing, unsolicited e-mailings, newsgroup spamming, child pornography, hardcore pornography or links to such sites, copyrighted MP3, copyrighted music, copyrighted video, illegal content, copyright infringement, trademark infringement, warez, cracks, software serial numbers, proxy(ies) and image/file sharing web sites. Adishost will be the sole and final arbiter as to what constitutes a violation of this policy. Adishost does not normally monitor the contents of clients servers, however if suspicion occurs, Adishost reserves the right to investigate and terminate the clients subscription to the service.

CHOICE OF LAW

This Agreement shall be interpreted under the laws of Iran without regard to any conflict of laws provisions. Any action between the parties to this agreement for the breach of this agreement or any action or claim in any way relating thereto shall be venued in the Superior Court of Iran. The parties to this agreement hereby consent to jurisdiction in that court and agree to accept service by mail and hereby waive any defense of any kind related to jurisdiction or venue.

Backups and data loss

It is the responsibility of the customer to keep up-to-date archives of their backed up data. Adishost does not provide or keep records or copies of our clients web site files for customer use and is not responsible for any loss of data including but not limited to hardware failure, backup failure, hacking or accidental deletion.

Support

If you are experiencing a problem with your hosting, you are required to notify us of the issue immediately, so we may resolve the issue. If you do not notify us of the problem, no allowances will be made, as we have not been given a reasonable opportunity to resolve the issue. Adishost is not responsible for the users Internet Connectivity through their Internet Service Provider (ISP), connection troubleshooting or computer setup. Please contact your ISP for assistance in these matters. Where indicative times are given in regards to support issues, these are in no way any form of guarantee and are subject to change. Where possible the user will be kept up to date on the issue and it's likely timeline.

Hosting plans version

From time to time, we may update our hosting package plans. When a hosting plan is updated, the version number shown on the plan will change. Customers on previous plan version numbers will not be automatically upgraded to the newest version of the plan.

Cancellation

Adishost reserves the right to cancel any account at any time. If your account has been terminated or suspended for breaching our terms and conditions, non-payment or where a formal complaint is received, no refunds will be given. Any proof of misleading or giving false information to Adishost or its employees, including, threatening, extortion, harassment, improper conduct, abuse, swearing or other unlawful activities will lead to automatic cancellation of your account without refund. This can be email, live chat, telephone or in any form where staff are threatened, abused or mistreated. You can cancel your account at anytime by sending an email to our Support Center requesting this. You will be contacted via email to confirm this. The cancellation email must be 7 days before your package renewal date, otherwise you will be charged for the next billing cycle. Cancellation requests received after the package renewal date will be processed, however you will not receive a refund for the current billing cycle. Once you have cancelled your account, no further support resources will be provided by Adishost in relation to products and services on your account, including domain names, web hosting, ssl, etc. We will not engage your account in any way once your account has been cancelled. No refunds or credit will be given if you cancel your account or downgrade to a lower package.

Resource Usage

Users may not initiate the following: 1. Use 25% or more of system resources for longer then 60 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, scripts, FTP, PHP, HTTP, Mail, etc. 2. Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed. 3. Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. 4. Run any software that interfaces with an IRC (Internet Relay Chat) network. 5. Run any gaming servers such as counter-strike, half-life, battlefield1492, etc. 6. Any activity which causes the server to crash / restart.

Bandwidth Usage / Disk Space

It is your responsibility to upgrade your account and monitor your usage. You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount you will be required to upgrade to the next level plan of bandwidth usage and/or disk space. Our system will automatically suspend your account if you exceed all of your allocated resources. We reserve the right to suspend the account until the start of the next allocation or until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Price Change

We reserve the right to change prices listed on Adishost, and the right to increase the amount of resources given to plans. Customers will be notified by email before any price changes are implemented to their account. It is your responsibility to ensure your email address listed in our billing system is functional and working and can accept email from us.

Licensed Software Only

Client agrees to use only properly licensed third party software in connection with Client's use of the Services

Disclaimer

Adishost will not be responsible for any damages your business may suffer. Adishost makes no warranties of any kind, expressed or implied for services we provide. Adishost disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Adishost and its employees.

Changes to the Terms and Conditions

Adishost reserves the right to revise its policies from time to time without notice to you. By continued use of our services, you agree to and are bound by the updated terms and conditions, that can be accessed on our web site at any time.
